Terms & Conditions

Your participation in the Snapshot ®program and use of our mobile application for Snapshot (the “App”) is expressly conditioned on your acceptance of these terms and conditions. If you do not agree with any part of these terms and conditions, you should not participate in Snapshot.

The Progressive Group of Insurance Companies (Progressive) reserves the right to modify the terms and conditions at any time. Modifications to these Terms and Conditions can be viewed by logging in to your policy through  progressive.com. Continued participation in Snapshot by you will constitute your acceptance of any revisions to these terms and conditions. Please check this page regularly.

About Snapshot Mobile

Progressive offers a usage-based insurance rating program, called Snapshot, which allows customers to potentially save money based on their actual driving habits, like how they drive, how much they drive, and when they drive. Snapshot gives people more control over how much they pay for auto insurance and can help make people safer drivers.  With Snapshot, safe driving saves you more on your car insurance.

Customers who enroll in the mobile application version of Snapshot use their smartphone to collect data through the App. Progressive will use this data to calculate a driver score.

To participate in the Snapshot mobile program, each customer agrees to download the App, complete the registration process, and keep the App enabled while driving unless notified by Progressive that data collection is complete.

The Mobile App for Snapshot

Eligibility. Eligibility for the Snapshot program using the App is determined by whether (a) all rated drivers have an iPhone® or AndroidTM smartphone, (b) all vehicles are eligible for Snapshot mobile and (c) all rated drivers enroll in Snapshot. Permit drivers are not considered rated drivers.

Enrollment. Enrollment in Snapshot will occur upon completion of the following steps:

  • You enroll in Snapshot, either online, over the phone, or through your Progressive agent (where available);
  • You provide a valid e-mail address; and
  • You accept these Terms and Conditions for participating in the Snapshot program and
  • All rated drivers enrolled in Snapshot register the App within 45 days after enrollment.

Getting the App. You can download the App from the Apple® App Store or Google PlayTM.

Registration. Each rated driver on the policy will need to download and register the App on their own smartphone using their own phone number (which serves as the registration key). Once the registration key is recognized by us, the driver will be sent a random PIN via text to the smartphone number used to register. The driver will need to acknowledge the Mobile Application for Snapshot Terms and Conditions and the Snapshot Privacy Statement to complete registration; if not, the registration will be unsuccessful. The App should be kept on all drivers’ smartphones, and drivers should carry their phones when they drive.  

Data collected. Once downloaded and registered, the App will run in the background and collect driving and phone sensor data (“Snapshot Data”), which will be uploaded to Progressive and available for review through the App. Snapshot Data includes vehicle speed and location using GPS, time information, phone usage, and data from the phone’s sensors. Other information, such as trip duration, trip regularity (taking the same routes on a regular basis), and rates of acceleration and braking, is derived from speed, location, and time information. Location information may be used for underwriting purposes, to detect whether an accident may have occurred, or to assist in resolving a claim, as further described in Acknowledgement / Consent; and for research and development purposes. Where you drive is not used in determining your personalized rate. Phone and App analytics information is also collected, as described in the Snapshot Privacy Statement.

Collection of your Snapshot Data will begin on your first contact date, which is the latter of when App registration is successfully completed or the effective date of your policy.

Trip Categorization. The App categorizes whether you are a driver or passenger and mode of transportation (for example, car vs. bicycle) for each recorded trip. The ability to change how a trip is categorized will be available for a limited time after the trip is displayed. If too many trips are re-categorized, you may be opted out of Snapshot.

Usage Requirements. If the total time the App collects data from a participating smartphone during the policy period in which you enrolled is insufficient for Progressive to make a reasonable determination of your driving behavior, renewal pricing based on Snapshot Data may not be applied; and the participation discount, if applied, may be removed. In some states, if, at the second renewal following enrollment, the data collected is still insufficient, you may be removed from the Snapshot program and, you may receive a surcharge at renewal.

If a pattern of disabling the App suggests that reported driving behavior may not be representative of actual behavior, renewal pricing based on Snapshot Data may not be applied; the participation discount, if applied, may be removed; and, in some states, you may receive a surcharge at renewal.  

Technical issues with the App, or data quality or data transmission issues, may prevent us from providing renewal pricing based on Snapshot Data. Removal of renewal pricing for these reasons will not affect your future participation in Snapshot.

Safe Use of the Application. When using the App, please ensure that you:

  • Obey all traffic laws, including any laws that restrict the use of mobile devices while driving;
  • Use the App only when it is safe to do so and when it will not create any unnecessary distraction; and
  • Do not use the App for any illegal, hazardous, or unauthorized purposes, or in a manner that is not consistent with these Terms and Conditions.

Ownership, License. The App is the property of Progressive and its service provider, and is provided for each vehicle you enroll for participation in Snapshot. You are hereby granted a fully paid, nonexclusive, non-sublicensable, non-transferable, time-limited, revocable license to use the App subject to these Terms and Conditions. Progressive and its service provider retain all right, title, and interest in and to the App. You may not reverse engineer, disassemble, decompile, alter, duplicate, translate, make copies, or create derivative works from the App, except to the extent allowed under applicable law. If applicable law permits such activities, any information discovered as a result of these activities must be promptly disclosed to Progressive and is deemed to be the confidential and proprietary information of Progressive and its service provider.

The App contains certain third party software licensed under Open Source licenses.   See the App’s End User License Agreement for the applicable notices and licenses relevant to that software.

Deleting the App.  If the App is deleted, you may be opted out of the Snapshot program. See “Snapshot Pricing – Ending your Enrollment” below for details.

Acknowledgement/ Consent

By enrolling in Snapshot, you represent that you have the consent of each Snapshot participant to (a) provide information collected by the smartphone to us, and (b) permit us to retain and use the information as described in these terms and conditions. Once the Snapshot Data is sent to us, the recorded information will remain on the smartphone for a limited time for viewing, and then be deleted. Progressive will retain information collected or derived from the App, including but not limited to Snapshot Data, as required by our record retention policies.

Snapshot Data may be useful in determining the cause of an incident or accident (“Accident”). If you’re in an Accident, you may have a legal obligation to preserve the information on your phone. This information may be sought by opposing parties in a civil lawsuit or by police when investigating the cause of an Accident, or we may be legally obligated to provide such information in response to a subpoena or as otherwise required by law.

If the Snapshot Data is potentially relevant to an insurance claim with us, you agree we may use Snapshot Data to assist in resolving the claim.  This may include, but is not necessarily limited to, validating the circumstances of the Accident, such as date and time of loss and crash location; making liability and coverage determinations; conducting investigations of policy and/or claims fraud and material misrepresentation, including verifying information you’ve previously provided to us; and any potential subrogation or litigation involving the claim.

We may use Snapshot Data collected or derived from the App for underwriting purposes, including verification of information provided by you or with your consent; to service your insurance policy; to market our or our affiliates’ products and services to you; and for research and development.

The App temporarily stores Snapshot Data on your smartphone, and then uploads it for processing by Progressive. Transmission of Snapshot Data uses a portion of data on your cell phone plan. The online connection required to use the App, and any associated charges (e.g., mobile data expenses) incurred by your use of the App, are your exclusive responsibility and made solely at your expense.

For most smartphones, battery consumption is negligible when not collecting Snapshot Data. When driving, battery consumption is comparable to other driving and navigation apps. If the phone’s battery power is low, the App will reduce the data collected to conserve energy. Care should be taken to charge the battery while driving if you take longer car trips.

Snapshot Data

Privacy. We're committed to protecting your privacy and earning your trust, and understand you may have questions about how we use the Snapshot Data we collect. In addition to our commitment to you in our  Privacy & Security Policy, we explain what we will and won’t do with Snapshot Data in our Snapshot Mobile Privacy Statement.

Viewing Snapshot Data. Customers will be able to review reports on their driving habits produced from Snapshot Data through the App. Location information and trip maps are only available on the individual phone which collected the information.

Limited Snapshot Data for all Snapshot participants will be available to customers who log into their policy online or via the App. No location data for other phones will be available – just summaries of hard braking, hard accelerations, time of day, distracted driving and mileage.

Snapshot Pricing

Snapshot Data will be used in determining your personalized rate, which may result in a discount, or in some states, a surcharge to your policy premium depending on your driving habits and conditions.

In some states and situations, Snapshot pricing works as follows:

  • Participation Discount. New customers to Progressive will be eligible for a Snapshot participation discount for up to the first two policy terms until sufficient Snapshot Data has been collected, contingent upon completion of Snapshot registration within 45 days of enrollment.  
  • Snapshot Results. If sufficient Snapshot Data is collected in a policy term, we will calculate a driving score based on that information and use this score to determine a personalized rate at each renewal. Our interpretation of what the score means in terms of pricing may change over time based on factors we file with your state’s department of insurance. Snapshot results may also be considered in determining pricing tier and in making underwriting decisions.  Your driving score will be updated at each renewal based on the Snapshot Data collected in the most recent policy term.
  • Ending Your Enrollment. You can opt out of Snapshot before we have completed reviewing your Snapshot Data. If you opt out within 45 days of enrolling in Snapshot, we won’t consider your Snapshot experience at all. If you opt out after 45 days of enrolling in Snapshot and we have collected sufficient Snapshot Data to establish a driving score, that score will be used to determine a personalized rate at each renewal.   In some states, if you chose to download the App and register your phone, and then opt out more than 45 days after completing registration in Snapshot and we have not collected sufficient Snapshot Data to establish a driving score, you may receive a surcharge or loss of a discount to your policy when it comes up for renewal.

In other states and situations, where Snapshot data is not collected continuously, Snapshot pricing works as follows:

  • Participation Discount. New customers to Progressive will be eligible for a Snapshot participation discount during their first policy term contingent upon completion of Snapshot registration within 45 days of enrollment.  
  • Snapshot Results. After collecting sufficient Snapshot Data, we will calculate a driving score based on that information and use this score to determine a personalized rate. Once we collect sufficient Snapshot Data to establish the driving score, our interpretation of what the score means in terms of pricing may change over time based on factors we file with your state’s department of insurance. Snapshot results may also be considered in determining pricing tier and in making underwriting decisions.  Your driving score will remain the same for each renewal, until such time as Progressive, in its sole discretion, elects to collect additional Snapshot Data to re-evaluate the driving score or you choose to re-enroll in Snapshot and provide sufficient Snapshot Data to recalculate your driving score.
  • Ending Your Enrollment. You can opt out of Snapshot before we have completed reviewing your Snapshot Data. If you opt out within 45 days of enrolling in Snapshot, we won’t consider your Snapshot experience at all. In some states, if you chose to download the App and register your phone, and then opt out more than 45 days after being enrolled in Snapshot, you may receive a surcharge or loss of a discount to your policy when it comes up for renewal.

In some cases, the Snapshot program will affect the amount of your Paid in Full or EFT discount savings.

Communications

We will periodically send you reminders and other information through the App, by e-mail, and/or by phone while you’re participating in Snapshot.

Your Representations

You represent and agree that:

  • You are solely responsible for any data charges resulting from your use of the App;
  • The App is intended for use by users who are of the legal age required by your state to hold a driver’s license; and in any case, that you are at least 13 years old;
  • You are not on any U.S. Government list of prohibited or restricted parties.

Disclaimer / Limitation of Liability

YOU UNDERSTAND THAT THE APP, INCLUDING OPEN SOURCE SOFTWARE INCORPORATED THEREIN, IS, TO THE FULLEST EXTENT PERMITTED BY LAW, BEING PROVIDED TO YOU “AS IS,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.   YOU AGREE THAT WITH REGARD TO YOUR USE OF THE APP THAT, TO THE FULLEST EXTENT PERMITTED BY LAW, PROGRESSIVE SHALL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE OR INDIRECT DAMAGES OF ANY NATURE, WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT (INCLUDING NEGLIGENCE OR STRICT LIABILITY) OR OTHERWISE, EVEN IF IT HAS BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS OF OPEN SOURCE CODE USED IN THE APP BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

Progressive reserves the right to modify or terminate the Snapshot program at any time and for any reason.

Accident Response

The App may come equipped with our built-in Accident Response feature.  In your state or situation, we may automatically turn on this feature for you after you successfully complete Snapshot registration.  If so, the App will inform you that Accident Response is turned on, but you can turn it off in the settings within the App.  If Accident Response is not automatically turned on in your situation, you may be able to enroll in Accident Response via the App.

Accident Response uses the sensors in your phone to detect if you are in a major motor vehicle collision (“Event”).  When Accident Response is on, the App may detect if you are involved in an Event.  If an Event is detected, the App will initiate automated call(s) or texts to your device, or push notifications or in-app message(s) through the App, asking for your response to confirm the Event and determine whether you require an ambulance or tow service. If you affirmatively confirm the Event and request an ambulance or tow, a call center managed by Progressive or its vendor(s) will initiate dispatch of these services on your behalf to your device location.  If you do not respond to our attempts to reach you, we may, without your confirmation, initiate a 911 call for emergency assistance to your device location. If we determine you are not in need of emergency assistance, including if (where available) we detect you are driving the vehicle again within a pre-determined time period after the detected Event, we may discontinue any further outreach related to this Event.

Consent to Contact

WHEN ACCIDENT RESPONSE IS ON, YOU EXPRESSLY CONSENT TO ALLOW PROGRESSIVE AND/OR ITS VENDOR(S) TO CONTACT YOU OR YOUR DEVICE BY PUSH NOTIFICATION, IN-APP MESSAGE, TEXT MESSAGE, OR PHONE CALL, INCLUDING THROUGH USE OF AN AUTOMATIC TELEPHONE DIALING SYSTEM, IN CONNECTION WITH THE DETECTION OF AN EVENT. YOU ALSO CONSENT THAT ANY CALL MADE TO YOU OR YOUR DEVICE MAY BE RECORDED.

Consent to Use Snapshot Data

By participating in Accident Response, you acknowledge and consent to the following:

We will analyze Snapshot Data for detecting whether an Event may have occurred, and for offering assistance to you at the scene. You will provide to us Snapshot Data, and permit us to retain and use Snapshot Data and information resulting from or in the management of an Event. 

If an Event is detected and an ambulance or tow is dispatched, we will automatically open a claim under your policy.  We will not automatically open a claim if only a tow is dispatched, and you pay for that tow out of your own pocket when service is rendered.  The dispatching of emergency services and/or a tow truck by us shall not be deemed a determination of coverage under your policy. 

Availability

Accident Response will only be available while the App is installed and all required permissions are enabled. Accident Response is available where the App is available, the service is offered, and the policyholder and/or other drivers on the policy are eligible. Accident Response will only detect Events and provide tow and ambulance services in the 48 contiguous United States, plus Alaska, Hawaii, and the District of Columbia; and only when the App is actively monitoring your driving behavior.

Disclaimer / Limitation of Liability

The App is intended to detect major Events, but may not detect all Events. Additionally, the App may incorrectly identify some non-collisions as Events.  You will be required to pay for ambulance and/or towing services you’ve requested if you do not have the requisite insurance coverage.

PROGRESSIVE AND ITS VENDORS DO NOT WARRANT OR GUARANTEE THAT ACCIDENT RESPONSE PROGRAM SERVICES WILL WORK IN ANY OR EVERY CIRCUMSTANCE, DETECT AND/OR REPORT ANY OR ALL COLLISIONS, AVOID ANY OR ALL FALSE POSITIVES, OR THAT AN AMBULANCE OR TOW WOULD BE PROVIDED IF AN EVENT OCCURS, EVEN IF REQUESTED.  WITHOUT LIMITATION, HARDWARE ISSUES OR FAILURES MAY PREVENT EVENT DETECTION, CAUSE LIMITATIONS OR ERRORS IN THE ALGORITHM, AND PROCESSES USED BY THE APP MAY NOT FUNCTION PROPERLY.  ACCIDENT RESPONSE IS NOT A REPLACEMENT FOR 911. YOU ARE ENCOURAGED TO ALWAYS DIAL 911 IMMEDIATELY IN THE EVENT OF A SERIOUS CRASH, OR A CRASH INVOLVING INJURY.

YOU UNDERSTAND THAT PROGRESSIVE AND ITS VENDORS CANNOT ASSURE YOU, OR MAKE ANY GUARANTEES, ABOUT THE MANNER OR TIMELINESS OF THIRD-PARTY EMERGENCY RESPONSE OR EVEN WHETHER THIRD PARTY EMERGENCY RESPONDERS WILL IN FACT RESPOND TO YOUR EMERGENCY AT ALL.  IN NO EVENT SHALL PROGRESSIVE AND ITS VENDORS BE HELD LIABLE IN INSTANCES WHERE THE APP HAS BEEN HINDERED FROM OPERATING; FOR THE TIMELINESS OF THE RESPONSE OF EMERGENCY ASSISTIVE SERVICES OR THEIR FAILURE TO ARRIVE AT THE SCENE OF THE EVENT; AND WHERE ACCIDENT RESPONSE FAILS TO OPERATE AS DESCRIBED OR EXPECTED.

Patent Notice

U.S. Patent Nos. 9,754,424, 9,916,625, 10,497,063, and 11,030,702, and any additional patents and pending applications claiming priority from these patents, or otherwise related to Progressive’s usage-based insurance program, apply to the Snapshot program, device, and/or mobile app.
